As a member of The Circle Club, you shall be subject to the following Terms and Conditions, Confidentiality Agreement and Members’ Charter. Your Membership commences upon payment of your first month’s membership fee. You are urged to read these Terms and Conditions, the Members’ Charter and Confidentiality Agreement carefully in order to enable you to enjoy successful membership with The Circle Club.
1. The Circle Club Ethos and Philosophy
Our Business Community is built upon the idea of reciprocity. We achieve success for one another’s businesses by offering support for other members and committing to an approach of ‘One-for-all and all-for-one’.
2. Interpretation
1.1 Unless the context otherwise requires, each reference in these Terms and Conditions to:
1.2 “these Terms and Conditions” is a reference to these Terms and
1.2.1 Conditions; and
1.2.2 a Clause or sub-Clause is a reference to a Clause of these Terms and Conditions.
1.3 The headings used in these Terms and Conditions are for convenience only and shall not affect the interpretation of these Terms and Conditions.
1.4 Words signifying the singular number shall include the plural and vice versa.
1.5 References to any gender shall include the other gender.
3. Membership
2.1 You may apply to become a member of The Circle Club by completing the Application Form, being voted in by existing members (over 75% majority) and agreeing in that form to these Terms and Conditions.
2.2 The details that you provide and confirm in the Application Form must be complete, correct and accurate (as we use this to promote you and your businesses so we take no liability for mistakes) including your confirmation that you agree to these Terms and Conditions.
2.3 You will become a member of The Circle Club only if and when your application is accepted in writing (via email) and you have paid the first month of the membership fee. Current members of The Circle Club will vote on whether to accept or decline your application based on the information you have submitted in the Application Form. If more than 75% of The Circle Club’s existing members decide to vote you into the club your application will be approved. As Founder of The Circle Club, the final decision whether or not to accept your application is at the absolute discretion of Alexandra Slack or an appointed representative.
2.4 Your membership may be terminated by Alexandra Slack or an appointed representative at any time without reason at her sole discretion.
2.6 For members that entered into the Contracted membership shall be for an initial minimum term of 12 consecutive months. After 12 month’s membership, you may at any time terminate your membership by providing 30 days’ notice in writing to The House of LM Limited.
2.8 Members entering The Circle Club upon a special offer may at any time terminate your membership by providing 30 days’ notice in writing to The House of LM Limited.
4. General
3.1 At The Circle Club we offer a ‘No Lockout Policy” which means we have no limit to the number of members from the same industry within each region. We believe in collaboration and an abundance mindset.
3.3 In case of problems with a member, Alexandra Slack (or an appointed representative) may, at their sole discretion, put a member on probation relating to the member’s business practices or commitment to The Circle Club.
3.4 Memberships may be revoked for failure to comply with these Terms and Conditions and/or the Members’ Charter.
3.5 The Circle Club Member’s lists are for the purpose of ‘giving’ referrals and not for soliciting (via email, direct mail or other means) The Circle Club Business members without their prior approval.
3.6 Other than normal Circle Club printed materials, members may not use The Circle Club Intellectual Property (e.g. logos, trademarks, names, slogans. Copyrighted materials, etc.) to manufacture, distribute, sell, market, or promote any of their services without the prior written consent of Alexandra Slack or an appointed representative.
3.8 These Terms and Conditions may change from time to time without giving notice, but reasonable endeavours shall be made to inform You as soon as is reasonably possible of any such change.
3.9 All personal information that may be used will be collected, processed and held in accordance with the provisions of any data protection legislation from time to time in force in the United Kingdom including, but not limited to, the Data Protection Act 2018, any legislation which succeeds that Act, the retained EU law version of the General Data Protection Regulation ((EU) 2016/679) (the “UK GDPR”), as it forms part of the law of England and Wales, Scotland, and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018, and, where applicable, guidance and codes of practice issued by the Information Commissioner and your rights under the GDPR. 3.10 Feedback from members is always welcome, and, whilst all reasonable endeavours are used to ensure that your experience as a member is a positive one, we want to hear from you if You have any cause for complaint. If You have any complaint, please raise the matter with us by emailing hello@the-circle.club.
3.11 No failure or delay in exercising any rights under these Terms and Conditions means that the right has been waived, and no waiver by a breach of any provision of these Terms and Conditions means that we will waive any subsequent breach of the same or any other provision.
3.13 These Terms and Conditions, the Contract, and the relationship between us (whether contractual or otherwise) shall be governed by and construed in accordance with the law of England & Wales.
5. Administration
4.1 Fees shall be paid monthly except for a one-off joining fee.
4.1.1 You may pay the Membership Fee using any of the following methods:
4.1.1.1. Go Cardless, Direct Debit or Standing Order.
4.1.2 All prices of Services shown in the Price List are exclusive of VAT.
4.2 Although this a business club and a company may pay for the membership, membership lies with the individual (that completed the application form and as a result was voted in). Therefore, if the company wants to send another representative in place, that new individual has to be voted in. If you cannot attend a meeting, you cannot send a substitute, the individual who has the membership must send their apologies.
4.3 Your membership is for your chosen region only. Cross County membership is available for an additional but heavily discounted cost and there is no contract for bolt-on counties. An individual (not a company) can purchase as many regions as requested.
4.4 If you are not happy with your membership for any reason, you have 30 days to claim your money back. (*You must have attended at least 1 Members’ Meeting and have received your initial consultation during this time period).
4.5 Fees cannot be transferred from one person to another unless the same company paid the fees.
4.6 The Circle Club events are subject to change from time to time, but we aim to provide as much prior notice as possible of any such changes.
